Background checks in California
State reporting rules
Legal review requiredGenerally 7 years from disposition, release or parole for CRAs (Cal. Civ. Code §1786.18).
Salary exception: No salary exception under ICRAA.
FCRA baseline
The FCRA requires a standalone disclosure, written authorization and a two-step adverse action process. Non-conviction records older than seven years generally aren't reportable unless the position pays $75,000 or more.
Additional considerations
- Statewide Fair Chance Act applies to employers with 5+ employees.
- ICRAA adds disclosure requirements beyond the FCRA.
